Legislation: what the law says about transporting dogs in cars

Ensuring the safety of the dog and the people inside and outside the vehicle is the main objective. However, if you don't want to pay fines and lose points on your license, it's also important to pay attention to what the law says about transporting dogs and other pets.

The Brazilian Traffic Code does not prohibit the transport of animals in passenger vehicles . However, although it does not have a specific law for transporting dogs , it is quite clear regarding certain precautions that must be taken. We have selected 3 articles from the Brazilian Traffic Code that relate to the transport of animals.

Art. 252

What the law says : according to section II, driving a vehicle "transporting people, animals or objects to your left, or between your arms and legs" is considered a medium-level infraction, punishable by a fine and points deducted from your driver's license.

What this means : under no circumstances can the driver carry the pet in their lap, hold it by the arm, or place it between their legs while driving. If the pet is not accompanied in the car, the driver should preferably leave the pet in the back seat or in a dog carrier.

Art. 235

What the law says : it is considered a serious offense, punishable by a fine, loss of points on the driver's license, and vehicle impoundment for transshipment, to "transport people, animals, or cargo on the exterior parts of the vehicle, except when duly authorized."

What it means : it is not allowed to transport dogs in the bed of pickup trucks, vans, etc. It is also prohibited to leave the dog with its head or any other part of its body outside the vehicle while the car is in transit.

Art. 169

What the law says : it is considered a minor infraction, punishable by a fine and points deducted from the driver's license, to "drive without attention or without the care essential to safety".

What this means : transporting animals should never distract or hinder the driver. Therefore, it's best to keep the pet restrained and in a safe position.
